Marijuana Charges Dismissed Against Nurse
We recently defended a client had been charged with possession of marijuana after he was caught smoking a blunt at a rest stop off the New Jersey Turnpike. Undercover State Troopers snuck up on him and immediately placed him under arrest and confiscated the blunt and marijuana. Once charged, our client faced up to 6 months in jail, suspension of his driver’s license, probation and random drug testing.
It appeared to be a cut and dry situation where our client was caught red-handed. After months of back and forth, the prosecutor was unable to secure the discovery from the State Police and our attorneys made a motion to dismiss the charges against our client for lack of prosecution. After the judge heard arguments for both sides, he granted our motion and dismissed the charges in entirety. Our client was able to walk out of the courthouse free of all charges and fines. Moreover, his nursing license was unaffected since all the charges were dismissed.
