  • Second-degree aggravated assault – 5 to 10 years in state prison. This charge is subject to the No Early Release Act (NERA), which requires an individual to serve at least 85 percent of the sentence before becoming eligible for parole.
  • Third-degree aggravated assault – 3 to 5 years in prison. First-time offenders may be eligible for pretrial intervention (PTI) or probation, depending on the facts.
  • Fourth-degree aggravated assault – Up to 18 months in prison. Probation and diversion programs are more likely at this level, especially for defendants with no prior record.
