Plumsted Township’s court recorded 11 DWI filings over July 2025–June 2026, six fewer than the 17 of the prior year, in a 39-square-mile township where every DWI stop happens on a county road or local street, because no state highway passes through. Those 11 cases put Plumsted 31st of Ocean County’s 33 municipal courts by filings per resident. A Plumsted DWI is prosecuted in Plumsted Township Municipal Court, but the case is not heard in New Egypt: the court sits at 1 Colonial Drive, inside Manchester’s municipal building, on a Tuesday calendar set aside for Plumsted. Our Plumsted Township Municipal Court guide describes that setup, and our DWI defense page for Ocean County sorts out the rest of the county.
William Proetta Criminal Law defends Plumsted DWI cases rooted in stops on Main Street in New Egypt, County Route 539 near the speedway, and dark stretches of Monmouth Road along the Upper Freehold line. - Ocean County comparison: about 13.6 filings per 10,000 residents ranks 31st of 33 municipal courts; the raw count ranks 23rd.
- First offense at 0.08%–0.099% BAC: $250–$400 in fines, as many as 30 days behind bars, and a quarter-year of interlock driving.

Plumsted clients work directly with William A. Proetta. His certification on the Draeger Alcotest 9510 came from Draeger, the company that manufactures it, and his standing as a recognized instructor in the NHTSA Standardized Field Sobriety Tests (SFSTs) means he knows the testing script officers learn. Over fifteen years of criminal trial work back that up. On rural county roads, the reason for a stop is often a single observation, such as crossing the center line on a curve, a slow drift toward the shoulder, or speed through New Egypt’s downtown. Mr. Proetta takes that observation apart against the video and then does the same with each roadside test and the breath procedure. You will be talking with him, not passed between staff members.

DWI charges arising in Plumsted are generally heard in Plumsted Township Municipal Court. Your summons or court notice controls your appearance date, time, location and whether you appear in person or virtually.
Court Sessions, Contacts & What to Expect →Plumsted shares a courtroom and court office with Manchester and Lakehurst, but it has its own judge, its own municipal prosecutor and its own Tuesday calendar. Plumsted’s list is called at 9:30 a.m. on the first and third Tuesdays at the Colonial Drive building. Some of those Tuesdays run entirely on Zoom and others are held in the courtroom, and the notice you receive tells you which; don’t assume the format of your last date applies to the next. The court office, reachable at 732-657-8121, extension 3400, is open weekdays from 8:30 a.m. until 4:00 p.m. Weather closings go out on WOBM 92.7 FM. For a Plumsted resident, an in-person date means a trip out of the township to Manchester.

What Plumsted’s DWI Filings Show
For the court year ending June 2026, Plumsted’s municipal court counted 11 DWI filings, against 17 for the year ending June 2025. That is a decline of six cases, about 35%. Overall non-parking filings fell by a similar proportion, from 1,651 to 1,148, roughly 30% lower, so the drop in DWI cases tracks a broader decline in the court’s caseload.
Spread across 8,072 residents, eleven filings come to about 13.6 per 10,000, well under the county’s figure of roughly 32. Only Lavallette and Barnegat Light rank lower among Ocean County’s 33 courts. Nearby Ocean County townships run much higher: Jackson recorded about 30 filings per 10,000 and Manchester about 21. Geography helps explain the difference. Plumsted is a large, mostly rural township with New Egypt as its business district, and the only major roads through it are county routes, so it lacks the state-highway and Parkway traffic that feeds DWI dockets elsewhere.
With totals this small, a few arrests either way can change the percentages substantially, so the trend should not be overread. The figures count complaints rather than convictions and may record a refusal separately from the DWI it accompanies. They don’t show where in the township the stops occurred or how any case ended, and they cannot tell you whether your own stop and testing were handled lawfully.
Plumsted by the Numbers
Population, police staffing and municipal court DWI filings in context.
The 2020 Census is the source of Plumsted’s 8,072 residents and 39.14 square miles of land; PoliceCensus, drawing on 2025 FBI data, lists 14 sworn officers. Divide the land by the officers and each one covers, on paper, close to three square miles, which can mean a single officer making a stop with backup some distance away. The rate per 10,000 scales court activity to population; it is not a tally of locals charged, since a driver on CR 528, CR 537 or CR 539 may live anywhere. Each officer involved may have body-camera and patrol-car recordings and a written report, and we ask for every one of them.
DWI Stops on Plumsted's Major Roads
Where a DWI stop happens matters. The road determines which police agency made the stop, which court hears the case, what video and records exist, and whether the conditions were fair for field sobriety tests.
Major routes where DWI investigations can begin in Plumsted. This is not a list of arrest hotspots or checkpoint locations.
DWI Stops on County Route 528 (Main Street / Lakewood Road, New Egypt)
County Route 528 swings east onto Main Street through New Egypt’s commercial downtown, then leaves town as Lakewood Road, meeting CR 539 east of the village and heading on through the Pine Barrens into Jackson toward Lakewood. Trucks are routed around New Egypt on CR 528 Truck via CR 537 and CR 539. Plumsted police patrol the route, and stops can range from downtown speed and turns to lane drift on the wooded eastern stretch.
DWI Stops on County Route 539 (Pinehurst Road / Hornerstown-Whiting Road)
County Route 539 crosses more than eight miles of eastern Plumsted from north to south, passing New Egypt Speedway before crossing CR 528 and reaching CR 537. Northward it leads toward Allentown and Upper Freehold; southward it runs through Fort Dix lands toward Manchester and Whiting. Plumsted police cover it and handled a fatal 2019 crash outside the speedway. Long rural stretches mean the shoulder and lighting at the stop location deserve scrutiny.
DWI Stops on County Route 537 (Monmouth Road)
Monmouth Road, County Route 537, follows Plumsted’s northern border with Upper Freehold Township, carrying the CR 528 Truck route and meeting CR 539. With no state or interstate highway in the township, county routes like this one carry its through traffic, and I-195 is reached only via Upper Freehold or Jackson. Because the road traces a county line, the exact stop location decides whether Plumsted police and court or a Monmouth County agency are involved.
Plumsted has its own police department, and its officers make the DWI stops on the township’s county routes and local roads. There is no state highway, interstate or Parkway in the township; the nearest limited-access road is I-195, reached through Upper Freehold or Jackson. Troopers of the New Jersey State Police have statewide authority, so the arresting agency should be confirmed, not assumed. Boundaries matter here as well: County Route 537 traces the Upper Freehold line, and a stop on the Monmouth County side belongs to Upper Freehold’s court. County Route 539 also heads south through Fort Dix lands toward Manchester and Whiting. We pin down the precise stop location from dispatch records and video and request materials from every responding agency.
Reviewing the Evidence in a Plumsted DWI Case
Each Plumsted case is tested at four points: the legal basis for the stop, the grounds to expand it into a DWI investigation, the probable cause for arrest, and the reliability of the breath test. Video and audio recordings, not the summary report, are the measure for each.
Roadside observations and field sobriety tests
Balance tests on a country road are a different exercise from field tests in a parking lot. On the rural stretches of County Routes 528, 537 and 539, outside New Egypt’s downtown, a driver may be asked to walk a line on a narrow, uneven or gravel shoulder, lit mainly by headlights and the patrol car’s emergency lights. Those lights can interfere with the gaze nystagmus test, and surface and slope can unsettle the walking test and the single-leg stand. NHTSA’s research assumed level, dry, well-lit conditions. Mr. Proetta checks the setting on the video, then the instructions, demonstrations and scoring, against the manual. Our field sobriety test page has more.
Turning down the roadside exercises is your right, and on its own it does not give police probable cause to arrest; they must point to other evidence too.
Breath-test records and the testing timeline
A 2008 decision, State v. Chun, still governs: a breath reading is admissible only when police followed the procedures the Supreme Court laid down there. The most frequently disputed of these is the 20-minute observation period. Before any sample, the operator must observe the subject continuously for twenty minutes to rule out regurgitation, belching or anything in the mouth that could leave residual alcohol. However far the instrument was from the roadside, the clock from stop to sample deserves close attention. We reconcile the Alcohol Influence Report against video time stamps and obtain the operator’s certification, calibration and control-test documents, and the instrument’s data. Details are on our Alcotest 9510 page.
Refusal allegations
Declining roadside tests carries no separate penalty, but refusing the post-arrest breath test is its own violation of 39:4-50.4a. Conviction requires proof of three things: a lawful basis to arrest, the standard statement read word for word, and a real refusal, as opposed to trying and failing to provide adequate samples. First-time refusal exposure: a $300 minimum fine (up to $500), a license held back until a device goes in, then 9 to 15 months with it, a sentence that survives even when the DWI collapses. Details: refusal defense.
New Jersey DWI Penalties
| Offense | Fine | Jail | License / Ignition Interlock |
|---|---|---|---|
| 1st – BAC 0.08% to under 0.10% | $250–$400 | Up to 30 days | Interlock for 3 months |
| 1st – BAC 0.10% to under 0.15% | $300–$500 | Up to 30 days | Interlock for 7 months to 1 year |
| 1st – BAC 0.15% or higher | $300–$500 | Up to 30 days | 3-month suspension after interlock is installed, then interlock for 12–15 months |
| 1st – Drug DWI | $300–$500 | Up to 30 days | 7 month to 1 year suspension |
| 2nd offense | $500–$1,000 | 48 hours to 90 days | 1–2 year suspension, then interlock for 2–4 years; 30 days community service |
| 3rd offense | $1,000 | 180 days | 8 year suspension, then interlock for 2–4 years; 30 days community service |
Those are not the only costs. Every person convicted must complete the Intoxicated Driver Resource Center program, and the Motor Vehicle Commission adds a surcharge each year for three years, $1,000 annually after DWI one or two, $1,500 annually after DWI three. P.L.2025, c.41, enacted in 2025, also changed how suspensions work: a driver who would otherwise be suspended may elect to drive with an interlock and have the suspension reduced by one day for every two days of interlock use. That credit does not apply to drug DWIs or to cases involving serious bodily injury.

Can a Plumsted DWI Case Be Resolved Through a Plea Agreement?
The rules allow it now, but the odds are low. After lawmakers approved DWI plea bargaining, the Supreme Court withdrew Guideline 4, the municipal-court rule that had blocked them, in February 2024. Municipal prosecutors have nevertheless kept DWI offers rare, so a Plumsted defendant heading to the Manchester courtroom should not expect a downgraded charge to be on the table.
Leverage, when it exists, comes from the evidence. A stop on CR 528 or CR 539 with no lawful justification, balance tests on a gravel shoulder, or an observation period the booking video contradicts can get evidence thrown out or the case dismissed. Prosecutors facing that risk negotiate more readily. Even then, a judge must accept any plea and hear the defendant admit the conduct that supports it.
Preparing for Your Plumsted Court Appearance
- Remember court is in Manchester. Plumsted cases are called in Manchester’s municipal building on Colonial Drive, never in New Egypt.
- Look for the Tuesday format on your notice. First- and third-Tuesday sessions at 9:30 a.m. may be entirely on Zoom or fully in person.
- For Zoom dates, join from a quiet place with a charged device and stable connection, and never from a moving car.
- Write down the stop location by road and nearest landmark (New Egypt’s Main Street, the speedway on CR 539, or Monmouth Road near the Upper Freehold line).
- Hold on to every ticket and release form, and note how long you waited before the breath test.
- Bring a lawyer in early so discovery and video requests are made before your first Tuesday. Our New Jersey DWI page outlines the full process.
Plumsted DWI FAQs
Where do I go to court for a DWI in Plumsted or New Egypt?
Plumsted Township Municipal Court hears New Egypt and other Plumsted DWI cases in the Manchester Municipal Building, 1 Colonial Drive, Manchester. Plumsted’s calendar is called first and third Tuesdays, 9:30 a.m., and some sessions are held entirely on Zoom. The court office number is 732-657-8121, extension 3400.
Is Plumsted’s court the same as Manchester’s court?
No. Plumsted Township Municipal Court shares a courtroom and court office with Manchester and Lakehurst, but Plumsted has its own judge, municipal prosecutor and Tuesday calendar. A DWI from a stop in Plumsted stays a Plumsted case even though it is heard in Manchester.
How many DWI arrests happen in Plumsted Township?
Plumsted Township Municipal Court recorded 11 DWI filings during July 2025–June 2026, after 17 a year earlier. That works out to about 13.6 per 10,000 residents, 31st among Ocean County’s 33 municipal courts. Those numbers are complaints filed, which is not the same as Plumsted convictions.
I was stopped on Monmouth Road (Route 537) near Upper Freehold. Is my DWI in Plumsted?
Only if the stop was on the Plumsted side. County Route 537 runs along Plumsted’s northern border with Upper Freehold in Monmouth County, so a stop there could be filed in either municipality’s court. Check the court named at the top of your Plumsted or Upper Freehold summons.
How long will I need an interlock after a first Plumsted DWI?
It depends on the BAC. For a first Plumsted DWI, a reading of 0.08% to under 0.10% means three months with an interlock, and 0.10% to under 0.15% means seven months to one year. At 0.15% or above there is a three-month suspension once the interlock is installed and then 12 to 15 months of interlock, while a first drug DWI brings a seven-month to one-year suspension.
Will a Plumsted DWI show up as a crime on my record?
A Plumsted DWI is not a crime in New Jersey; it is a Title 39 motor vehicle offense tried by a municipal judge, without a jury. A Plumsted conviction still costs money, driving time and possibly liberty, and New Jersey will not expunge it later.
