Is It Legal in New Jersey? Drugs and Substances, Answered

Reviewed by William A. Proetta, Esq. · Updated October 2026

In New Jersey, adults 21 and older may legally possess up to 1 ounce of marijuana, and possessing up to 6 ounces is not punishable. Psilocybin mushrooms, LSD, MDMA, ketamine, synthetic cannabinoids and steroids without a prescription all remain illegal, while kratom is not scheduled and the new hemp and THC-drink rules mostly regulate sellers.

This chapter of our New Jersey drug laws guide states the law as of October 2026, with the statute behind each answer. Several rules changed in 2021 and again in 2026, so older articles often get them wrong. It explains the law and the penalty only; it does not advise anyone on using any substance.

How Much Weed Can You Carry in New Jersey?

An adult 21 or older may legally possess 1 ounce of usable cannabis or 5 grams of resin. Possessing more than that, up to 6 ounces of marijuana or 17 grams of hashish, “is not subject to any punishment” under N.J.S.A. 2C:35-10a(4)(b). It is not a crime, offense or civil violation, though police may seize the amount over 1 ounce.

Even a 4th-degree violation for more than 6 ounces cannot, by itself, cost a person a license, housing or financial assistance, or parental rights (N.J.S.A. 2C:35-10a(3)(b)(ii)). Landlords and condominium associations may still ban smoking on their property.

What Is Still a Crime for Adults?

  • Home grow. Growing is still illegal for everyone, including medical patients. Under N.J.S.A. 2C:35-5b(10), 50 or more plants is 1st degree and 10 to 49 plants is 2nd degree, whatever the weight. Fewer than 10 plants are graded by weight, and more than 1 ounce is 3rd degree. A bill to allow it, S2564, is stalled.
  • More than 6 ounces of marijuana or 17 grams of hashish. A 4th-degree crime with up to 18 months and a fine of up to $25,000.
  • Selling without a license. Distributing 1 ounce or less of marijuana, or 5 grams or less of hashish, brings a written warning the first time and a 4th-degree charge after that. More than 1 ounce but under 5 pounds is 3rd degree.

Can I Smoke Weed in Public in New Jersey?

No. The law does not allow smoking, vaping or aerosolizing cannabis in a public place, and the Smoke-Free Air Act (N.J.S.A. 26:3D-55) covers indoor public places. For adults it is not a crime. Towns enforce it with civil fines, commonly up to $200 under local ordinances. Using marijuana on school property is a disorderly persons offense (N.J.S.A. 2C:33-16).

Is It Illegal to Buy Weed From an Unlicensed Seller?

We found no statute that punishes the buyer. Possessing 6 ounces or less is not punishable whatever the source. The seller, however, is exposed to the distribution penalties above, and unregulated marijuana may not be sold.

Can I Have Weed in My Car?

Yes, if it is sealed in its original container or kept in the trunk; open cannabis in the cabin can be cited as an open container, and driving high is DWI. Our chapter on drugs, your car and your license covers the details.

Is Marijuana Legal Under Federal Law Now?

No. Since April 28, 2026, marijuana under a state medical marijuana license is federal Schedule III, but adult-use marijuana remains Schedule I as of October 2026.

What Happens If Someone Under 21 Is Caught With Weed or Alcohol?

Underage possession or consumption of alcohol, cannabis or hashish in public places, schools or vehicles brings warnings, not fines, under N.J.S.A. 2C:33-15. A first violation is a written warning, a second adds information about community services, and a third or later brings a referral to those services, which the person may decline without being summonsed.

For minors under 18, parents must be notified starting with the first violation, a requirement added by P.L.2021, c.38. Police may not arrest the person or take them to a station, an underage person cannot lawfully consent to a search, and odor alone is not grounds to stop or search. Records are destroyed at the second anniversary or at age 21, whichever comes first. Separately, selling or giving any product with a detectable amount of THC to anyone under 21 is unlawful (P.L.2025, c.215).

Are Magic Mushrooms Legal in New Jersey?

No. Possessing 1 ounce or less of psilocybin is a disorderly persons offense under N.J.S.A. 2C:35-10a(5), added by P.L.2021, c.9, with up to 6 months in jail. More than 1 ounce is a 3rd-degree crime, and selling psilocybin is still a distribution crime under N.J.S.A. 2C:35-5.

Did New Jersey Legalize Psilocybin Therapy in 2026?

No. P.L.2025, c.296, approved January 20, 2026, is “An Act concerning a pilot program for psilocybin research and making an appropriation.” It funds research at three hospitals selected by the Department of Health, with $6 million appropriated, under FDA and DEA rules. It does not legalize personal possession, home growing or sales. It does not change any penalty, give arrest immunity or expunge past offenses.

Is Delta-8 Legal in New Jersey?

Delta-8 now counts toward the THC limits that separate hemp from cannabis, and over-limit products may be sold only by businesses licensed by the Cannabis Regulatory Commission. P.L.2025, c.215, approved January 12, 2026, defines a product as cannabis, not hemp, if it exceeds 0.3% total THC by dry weight or 0.4 milligrams of total THC per container. Delta-8, delta-10 and THC-A all count.

The law took effect January 13, 2026, and its ban on selling over-limit products without a license applies from April 13, 2026. Selling an over-limit product without a license carries the same criminal penalties as selling marijuana, plus civil penalties of at least $100 for a first violation, $1,000 for a second and $10,000 for a third. Selling chemically synthesized cannabinoids is prohibited. The new rules are aimed at sellers: we found no provision in the law that penalizes a consumer for possessing these products.

Can I Still Buy THC Drinks at the Liquor Store?

Only until November 13, 2026, when the temporary window for liquor licensees and licensed cannabis retailers closes. THC limits have applied since May 31, 2026 (P.L.2026, c.7), and a law signed May 29, 2026 (A5051/S4297) set them at 10 milligrams of THC per can and 200 milligrams per resealable 750-milliliter bottle, at 5 milligrams per serving. That law also lets some bars sell sealed drinks for off-premises consumption. As of October 2026, the Commission says beverages over 0.4 milligrams per container become cannabis on November 14, 2026.

Are Flavored Vapes Illegal in New Jersey?

Using one is not penalized. N.J.S.A. 2A:170-51.12 bars retailers from selling or giving away vapor products with any flavor other than tobacco, including mint and menthol, and the penalties fall only on the retailer. Our article on whether flavored vapes are illegal in New Jersey covers the details.

Is K2 or Spice Legal in New Jersey?

No. Manufacturing or distributing synthetic cannabinoids, or possessing them with intent to distribute, is 2nd degree at 1 ounce or more and 3rd degree under 1 ounce (N.J.S.A. 2C:35-5.3b). Simple possession is a 3rd-degree crime at 1 ounce or more and a 4th-degree crime under 1 ounce under the synthetic cannabinoid statute, P.L.2013, c.35, which reaches unscheduled chemicals that act on cannabinoid receptors. Synthetic cathinones (“bath salts”) have their own sections: distribution is 2nd degree at 1 ounce or more and 3rd degree under 1 ounce (N.J.S.A. 2C:35-5.3a), and possession is 3rd degree at 1 ounce or more and 4th degree under 1 ounce (N.J.S.A. 2C:35-10.3a). Our article on drug analogs and possession charges explains how look-alike chemicals are charged.

Is Kratom Legal in New Jersey?

Kratom is not a controlled substance in New Jersey as of October 2026; no statute schedules it. S829 (“CJ’s Law”) would make kratom a CDS, and S301, which cleared the Senate Health Committee in March 2026, would place 7-hydroxymitragynine (7-OH) in Schedule I. Neither is law. At the federal level, the DEA proposed in July 2026 to temporarily place 7-OH above a set threshold in Schedule I, and in August 2026 it temporarily placed three related compounds (mitragynine pseudoindoxyl, MGM-15 and MGM-16) in Schedule I. New Jersey’s regulations follow federal temporary scheduling orders, so those three compounds are controlled here too; kratom leaf itself is not.

Are LSD, MDMA and Ketamine Illegal in New Jersey?

Yes. LSD and MDMA are Schedule I and ketamine is Schedule III. Possessing any of them without a prescription is a 3rd-degree crime under N.J.S.A. 2C:35-10a(1), with 3 to 5 years and a fine of up to $35,000. Our drug weight and grading chart has the distribution thresholds.

Is CBD Legal in New Jersey?

The 2026 hemp law does not mention CBD by name. A CBD product with more than 0.4 milligrams of total THC per container is no longer hemp and is treated as cannabis. Products under the limits are hemp-derived cannabinoid products that licensed cannabis retailers may sell.

Are Steroids Legal in New Jersey?

Not without a prescription. Anabolic steroids, including testosterone, are Schedule III, so possessing them without a valid prescription is 3rd-degree possession under N.J.S.A. 2C:35-10a(1), and selling any amount is 3rd degree. Our page on steroid charges in New Jersey covers prescriptions, online orders and federal law.
