State v. T.Y.
Our client was charged with a DWI, Reckless Driving, Open Container of Alcohol, and No Insurance, among other offenses. The case arose after Plainsboro Police found our client with a flat tire, passed out on the side US Highway 1 and slumped over the wheel. After being awoken, our client was escorted out of the vehicle to perform standardized field sobriety tests (SFSTs). Unfortunately, T.Y. had trouble maintaining balance and following instructions and was arrested for DWI. Once back at the police station, T.Y. blew a 0.13% BAC reading. William A. Proetta, Esq. fought the case and argued that the client had consumed alcohol only after he had gotten a flat tire while waiting for a tow truck. In the end, the client pled guilty to Reckless Driving with a 45 day loss of license and 45 day interlock device period. The DWI and all remaining charges were dismissed.
