Linden Criminal Defense Lawyer
Linden’s court sits in the evening as well as the morning, and its docket includes drivers stopped on the Turnpike or Route 1&9 who don’t live anywhere near City Hall. Whatever brought you here, a conviction can leave a criminal record, a suspended license, or points and insurance surcharges that linger. We defend clients in Linden and in Union County’s other municipal courts.
Why Linden Clients Call Us
- Evening sessions three nights a week. Linden holds court at 5:00 p.m. on Mondays, Tuesdays and Wednesdays. We can schedule around your work hours and often appear in your place on eligible traffic matters.
- Linden’s prosecutor takes requests online. The court page links an NJMCdirect portal for asking the prosecutor for a downgrade or plea offer. We know what to put in that request and what not to admit in writing.
- DWI filings jumped. The NJ Judiciary counted 170 Linden DWI filings, up from 139 the prior year. The city sits on the Turnpike, Route 1&9 and Route 27, with the Parkway just past its western edge.
- Citizen complaints have a deadline each day. If a neighbor or coworker has signed a complaint against you, or you need to file one, timing matters; Linden accepts private complaints only until 1:00 p.m.
Linden’s Prosecutor Portal and Online Case Tools
Linden’s court page links several self-service tools. Used carefully, they can save a trip to City Hall; used carelessly, they can lock you into a plea.
- Prosecutor request portal. Through NJMCdirect, you can ask the Linden municipal prosecutor to consider a downgrade or make a plea offer. Anything you type becomes part of the file, so keep statements about the facts out of it.
- Online Municipal Case Resolution. Linden announced in December 2020 that drivers could dispute eligible moving violations through NJMCdirect without appearing in court.
- Plea by mail. A plea-by-mail form is posted on the city’s court page for offenses that qualify.
- Videos before court. The court page links a video preview of the courtroom and a recording of the judge’s opening remarks, which explain your rights at the start of each session.
- Public defender application. The form is linked from the court page, and the city lists publicdefender@linden-nj.gov at 301 North Wood Avenue.
Filing or Facing a Citizen Complaint in Linden
A private citizen can sign a complaint in Linden Municipal Court without the police filing charges first, for example after a dispute between neighbors, a fight outside a bar or a disagreement at work. Linden accepts private citizen complaints for filing only until 1:00 p.m., so arrive in the morning. After a complaint is filed, a judicial officer decides whether probable cause supports issuing a summons. If you received a summons that started this way, the person who signed it is a witness, not the prosecutor, and the case is handled like any other disorderly persons charge.

Breakdown by case type
Court performance (criminal and traffic)
Source: New Jersey Judiciary, Municipal Court Statistics, July 2025–June 2026, PDF page 531. Figures above combine the report’s criminal columns (indictable, disorderly/petty disorderly and 1,684 other criminal complaints), DWI and moving violations, and leave out 31,004 parking tickets. Including parking, the court recorded 43,953 total filings. Figures are reported by court, not by arresting agency or the defendant’s town of residence. A clearance rate above 100% means more cases were resolved than newly filed during the period; it is not a conviction rate. These figures are a reporting-period snapshot, not live court data.
What Linden’s Court Numbers Mean
Linden Municipal Court received 12,949 criminal and traffic filings in July 2025–June 2026, down about 9% from 14,205 a year earlier, the Judiciary reports. The criminal portion is substantial. There were 912 indictable complaints, which are transferred to Superior Court unless downgraded for municipal handling, and 1,516 disorderly persons and petty disorderly persons complaints. DWI filings went the other direction, rising about 22% to 170 from 139. Moving violations totaled 8,667, around 67% of filings.
It resolved 12,656 cases for a 98% clearance rate, a hair below even, which means the docket grew only slightly. Backlog sat at 2,021 and active pending cases at 4,165 in June 2026. Linden’s twice-daily sessions early in the week, plus a Friday morning list, give the court more calendar time than most to work that down. Parking is set apart: the city’s 31,004 parking tickets are not in these figures. Read them as a picture of the court’s workload; they cannot forecast how a given complaint ends.
Understanding Your Linden Municipal Court Summons
A Linden summons contains important information about the alleged offense including, the statute charged, the person or officer who issued the complaint, the location of court and when you are required to appear. The numbered areas below identify information worth carefully reviewing.
Key Information to Check
Court and Court Code
This identifies the municipality and court associated with the summons. For a case arising in Linden, look carefully at the court information printed on your paperwork.
Summons or Complaint Number
This number identifies the individual summons or complaint. It may be needed when communicating with the municipal court or reviewing court records.
Complainant or Issuing Officer
The summons may identify the police officer or other complainant who issued or signed the charge, along with the involved police agency.
Date, Time and Location
These fields identify when and where the alleged offense occurred. They can also help identify potentially relevant police reports, video or other evidence.
Court Date and Time
Your summons may contain an initial appearance date. A later notice from the court can change that date or the manner in which the appearance will occur.
Where to Appear
Review the court location and appearance instructions carefully. Some proceedings may be conducted in person while others may be scheduled remotely.

Appearing in Linden: Virtual and In Person
Linden’s court page links virtual-court login instructions, and the court also sits in person at City Hall. Your notice tells you which format applies to you.
- Follow the posted login instructions if your hearing is virtual, and join a few minutes early from a quiet place with a working camera and microphone.
- Watch the judge’s opening remarks video on the court page before your date. It covers the rights the judge reads aloud at the start of each session.
- Morning or evening? Linden calendars cases in a morning slot (9:00) and an evening slot (5:00). Check which session your notice lists, and if it’s unclear, email lindenmunicipalcourt@linden-nj.gov.
- Office hours are limited. The Violations Bureau closes at 3:00 p.m. on weekdays and opens at 8:30 a.m. (a city hours widget says 8:00), so call or visit early.
What Cases Does Linden Municipal Court Handle?
Traffic and DWI matters, low-level criminal complaints, citizen-filed charges and city ordinance cases all land on this docket. Frequent examples:
Criminal and Disorderly Persons Offenses
- Harassment, often raised in a citizen complaint over repeated unwanted contact, under N.J.S.A. 2C:33-4
- Assault of the “simple” variety, such as a shove or punch during a dispute, per N.J.S.A. 2C:12-1(a)
- Mischief to a car, fence or window, charged under N.J.S.A. 2C:17-3
- Retail theft and other low-value theft, under N.J.S.A. 2C:20-11 and 2C:20-3
- Public fighting or creating a hazardous condition, which falls under N.J.S.A. 2C:33-2
- Paraphernalia such as pipes or rolling papers tied to drug use, per N.J.S.A. 2C:36-2
DWI and Traffic Offenses
- DWI in Linden, based on impairment or a 0.08% BAC, under N.J.S.A. 39:4-50
- Alcotest refusal after an arrest, per N.J.S.A. 39:4-50.4a
- Suspended-license driving, charged under N.J.S.A. 39:3-40 when an MVC suspension is still active
- Careless driving, cited per N.J.S.A. 39:4-97 for driving that endangers others
- Leaving an accident, charged per N.J.S.A. 39:4-129 when a driver fails to stop and exchange information
- Uninsured driving, cited under N.J.S.A. 39:6B-2 when the car lacks valid liability coverage
Many Linden traffic tickets trace back to its highways: the New Jersey Turnpike (I-95), the western end of I-278, U.S. Routes 1&9 and Route 27, with the Garden State Parkway running just past the city’s western line. Truck and commuter traffic around the Bayway Refinery, Linden Airport and the Linden train station adds to the mix.
Paying or Contesting a Linden Ticket
Four payment routes exist: the Violations Bureau window inside City Hall, mail sent to 301 North Wood Avenue, NJMCdirect online, and an after-hours drop box.
- The drop box is in the parking garage at the Police Department, not inside City Hall. The city pointed drivers to it during past holiday closures.
- Before you pay, decide whether to fight. A Linden payment is treated as a guilty plea, so points, MVC surcharges and higher premiums follow, and the plea is very hard to reverse later.
- A downgrade may be possible. A lawyer can use the prosecutor portal or speak with the prosecutor directly to seek a lesser, no-point offense.
- If you can’t afford counsel, fill out the public defender application linked on the court page. The court reviews your income and the potential penalties to decide eligibility.
Preparing for Your Court Date
- Confirm the session time. With a morning and an evening calendar running on the same days, it is easy to arrive for the wrong one.
- Don’t rely on an old phone number. The city lists 908-474-8429 and 908-474-8619, while the NJ Judiciary lists 908-474-8423. Email is a good backup.
- Bring proof. A valid license, current registration and insurance card can sometimes resolve a documents ticket on the spot.
- Request postponements in writing and keep the confirmation; a missed date can bring a failure-to-appear suspension.
- Let your attorney negotiate. Avoid discussing what happened with the officer, the complaining witness or the prosecutor yourself.
When a Linden Charge Leaves Municipal Court
Not every complaint stays at City Hall. Linden police also sign indictable complaints, for offenses like aggravated assault, burglary, drug possession with intent to distribute and theft of $200 or more. Those cases leave City Hall and are handled by the Union County Prosecutor’s Office in Superior Court in neighboring Elizabeth. The prosecutor may later downgrade a charge and send it back to Linden Municipal Court. First-time defendants should ask whether they qualify for Pretrial Intervention (PTI) or another New Jersey diversionary program, which can end a case without a conviction.
Nearby Courts
Bordering Linden are Elizabeth, Roselle, Cranford, Clark and Rahway, plus Winfield Township. It also borders Carteret and Woodbridge Township in Middlesex County, and Staten Island lies across the Arthur Kill. City notices and forms are on the city’s court directory page.
