Simple assault under N.J.S.A. 2C:12-1(a) is a disorderly persons offense in New Jersey, punishable by up to six months in jail and a $1,000 fine, or a petty disorderly persons offense if it was a fight both people agreed to. In Hudson County, a simple assault charge is heard in the municipal court of the town where it happened, so a Hoboken bar fight goes to Hoboken Municipal Court and a Bayonne incident goes to Bayonne Municipal Court. William Proetta Criminal Law defends simple assault charges in every Hudson County court from our Jersey City office, with over 15 years of criminal trial experience. What Counts as Simple Assault in New Jersey
Under N.J.S.A. 2C:12-1(a), you can be charged with simple assault if you:
- Attempt to cause, or purposely, knowingly or recklessly cause, bodily injury to another person;
- Negligently cause bodily injury with a deadly weapon; or
- Attempt by physical menace to put someone in fear of imminent serious bodily injury.
“Bodily injury” means physical pain, illness or any impairment of physical condition. No visible injury is required, and an attempt is enough, which is why simple assault is charged so often after shoving matches, arguments that turn physical and crowded nights out.
Summons or Arrest?
Most simple assault charges are filed on a summons, which means you are released and given a court date. Domestic violence cases are different: if the alleged victim shows signs of injury, New Jersey law requires the officer to make an arrest, and the case is often filed on a complaint-warrant with a release decision, and possibly a pretrial detention motion, within 48 hours. Release usually comes with conditions such as no contact with the alleged victim. See our pretrial release and detention guide.
Simple Assault or Aggravated Assault?
The same incident can be charged either way. It becomes aggravated assault, an indictable crime prosecuted in Hudson County Superior Court in Jersey City, when the complaint alleges serious or significant bodily injury, a deadly weapon, or a protected victim such as a police officer, firefighter, EMT, teacher, bus driver or health care worker. The reverse also happens: after reviewing the evidence, the Hudson County Prosecutor’s Office often downgrades an aggravated assault to simple assault and sends it back to the municipal court where the incident occurred. Getting an indictable charge downgraded is often the most important result in the case.

Many Hudson simple assault cases involve cross-complaints, where each person files against the other. When that happens, both complaints are usually heard together, and how the other side’s complaint is handled can shape the outcome of yours.
Penalties and Consequences
- Disorderly persons simple assault: up to 6 months in jail and a $1,000 fine.
- Mutual fight (petty disorderly persons): up to 30 days in jail and a $500 fine.
- Other consequences: probation, restitution for medical bills or property, anger management, and a criminal record that shows up on background checks for jobs, housing and professional licenses. A conviction can also have immigration consequences for people who aren’t U.S. citizens.
Jail for a first offense is uncommon, but the record is the real cost, which is why the goal is usually a dismissal, a downgrade or a diversion program.
Immigration Consequences
A simple assault conviction usually isn’t treated as a crime involving moral turpitude, but it can still create problems for green card holders, visa holders and DACA recipients, especially when it involves domestic violence, because a crime of domestic violence can be a separate ground for deportation. How the plea is worded, which subsection of the statute is used, and whether the charge is resolved as an ordinance violation can all change the result. We review immigration consequences before any plea; see our immigration consequences practice area and immigration-safe plea strategy.
Simple Assault and Domestic Violence
When the people involved are spouses, family or household members, or current or former dating partners, simple assault is also an act of domestic violence. That adds a separate restraining order case in the Family Part of the Hudson County Superior Court in Jersey City, possible seizure of firearms, and conditions that can keep you out of your home. Conditional dismissal is generally unavailable in domestic violence cases. See our Hudson County domestic violence page.
Defenses to Simple Assault
- Self-defense under N.J.S.A. 2C:3-4, or defense of another person.
- No bodily injury and no attempt. Pushing past someone or a heated argument isn’t automatically assault.
- Mutual fight. Even if the State can prove a fight, a mutual fight is graded lower.
- Video and witnesses. Body-worn camera footage and bar, store and building cameras often contradict the complaint. Private systems are commonly overwritten within days, so we request footage right away.
- Credibility. Many cases rest on one person’s account, often given in the middle of a dispute.
How Hudson Simple Assault Cases Are Resolved
- Dismissal when the evidence doesn’t hold up or the complaining witness’s account falls apart.
- Downgrade to a petty disorderly persons offense or a municipal ordinance violation, which isn’t a criminal conviction.
- Conditional dismissal, a one-time program for eligible first offenders in municipal court. If you complete it, the charge is dismissed.
- Plea with a civil reservation, which keeps a guilty plea from being used against you in a related lawsuit.
- Trial before the municipal judge. There is no jury in municipal court.
A dismissed charge can usually be expunged soon after the dismissal, and a disorderly persons conviction generally after five years. See our Hudson County expungement page.
Hudson County Simple Assault FAQs
Is simple assault a felony in New Jersey?
No. Simple assault is a disorderly persons offense, New Jersey’s equivalent of a misdemeanor, and it is heard in municipal court. It becomes an indictable crime only if it’s charged as aggravated assault.
Which court handles a simple assault charge in Hudson County?
The municipal court in the town where the incident happened, such as Jersey City, Hoboken, Kearny, Union City or Bayonne Municipal Court. An aggravated assault that is downgraded to simple assault is sent back to that same municipal court.
Can I be charged with simple assault if nobody was hurt?
Yes. Attempting to cause bodily injury, or using physical menace to put someone in fear of serious injury, is enough under the statute. Whether the State can prove that attempt or fear is often the center of the defense.
Can a simple assault charge be dropped if the other person doesn’t want to proceed?
The decision belongs to the municipal prosecutor, not the alleged victim. A complaining witness who won’t cooperate often weakens the case, but the prosecutor can still go forward with video, police testimony or other witnesses.
Can I avoid a record for a first simple assault charge?
Often, yes, through a dismissal, a downgrade to a municipal ordinance violation, or conditional dismissal. Conditional dismissal is a one-time program and is generally unavailable in domestic violence cases.
Will a simple assault conviction affect my immigration status?
It can. Simple assault usually isn’t a crime involving moral turpitude, but a simple assault involving domestic violence can be treated as a deportable crime of domestic violence, and any conviction can complicate a green card or citizenship application. Resolving the case as a municipal ordinance violation or with careful plea wording can avoid many of those problems, so review the immigration side before you plead.
