What Is Aggravated Assault in Jersey City?
Aggravated assault is an indictable offense (similar to a felony in other states) under New Jersey law. It includes situations where someone causes or attempts to cause serious bodily injury, uses a deadly weapon, or assaults certain protected people, such as police officers, teachers, or emergency workers.
Simple assault is typically a disorderly persons offense (similar to a misdemeanor) involving minor injuries or threats. The key factors that raise an offense to aggravated assault include:
- The extent of the injury
- Whether a weapon was used
- The victim’s status (for example, whether they were a police officer or EMT)
- Whether the act was intentional, reckless, or negligent
Punching someone and breaking their jaw could be charged as aggravated assault. Similarly, so could threatening someone with a knife, even if no physical contact occurred. Jersey City prosecutors and police do not need to prove actual injury in every case. All they need to prove is that the threat or conduct was severe enough to meet statutory requirements.
Aggravated assault is an indictable offense, which means these cases are handled in Superior Court. If you are arrested in Jersey City, your case will likely be heard at the Hudson County Superior Court, located at 595 Newark Avenue. Municipal courts do not have jurisdiction over aggravated assault cases.
Types of Aggravated Assault Charges in Jersey City
New Jersey law has several degrees and categories of aggravated assault, depending on the specific circumstances, including:
- Second-degree aggravated assault – Causing serious bodily injury to another purposely, knowingly, or with extreme indifference is a second-degree crime. Second-degree aggravated assault also includes causing injury while trying to escape or resist arrest and assault with a deadly weapon under certain circumstances.
- Third-degree aggravated assault – Causing significant bodily injury with a deadly weapon or recklessly causing serious injury is a third-degree crime. Third-degree aggravated assault includes domestic violence-related assaults that result in significant injury.
- Fourth-degree aggravated assault – Pointing a firearm at someone (even without firing it) or injuring someone via criminal negligence while using a deadly weapon is a fourth-degree crime.
- Aggravated assault on a law enforcement officer or public employee – Any physical assault against law enforcement officers, firefighters, emergency services personnel, teachers, probation officers, or other protected public employees can be charged as third-degree crimes or second-degree crimes.

IS AGGRAVATED ASSAULT A FELONY?
The answer is Yes – and although that may seem evident to most, we actually come across this question a lot especially from people who are not familiar with the court system. This is why crimes of aggravated assault are always handled at the Superior Court along with other indictable crimes. However, it is important to note, that your aggravated assault charges can range in degree of crime depending on the facts – extent of injury to the victim, age of victim, if there was a weapon used, or if a police officer was injured. The three different degrees of severity are as follows:
2ND DEGREE AGGRAVATED ASSAULT DEFINITION & PENALTIES
Under rare circumstances, aggravated assault will be a second degree crime if you cause or attempt to cause serious bodily injury to another under circumstances manifesting extreme indifference to the value of human life. This usually means that the victim suffers a severe significant injury such as a broken bone or loss of a limb. Circumstances that often give rise to second degree aggravated assault charges are when defendants injury some while fleeing or eluding the police or cause serious injuries as a result of drunk driving. A second degree felony is punishable by 5 – 10 years in state prison and a fine of up to $150,000. Moreover, there is a presumption of mandatory incarceration if you are found guilty even for a first time offender with no criminal record.
3RD DEGREE AGGRAVATED ASSAULT PUNISHMENT & SENTENCING
It is third degree aggravated assault if you cause or attempt to cause significant bodily injury to another, even if it was done recklessly. Moreover, as a rule of thumb it is normally automatically a third degree aggravated assault crime when a weapon is used with the purpose to hurt another person. For example, if you exhibit or point a firearm at another, cause bodily injury to another with a “deadly weapon” or even use an imitation firearm to intimidate a police officer. A conviction for a third degree felony carries 3 – 5 years in state prison, a fine of up to $15,000 and a permanent criminal record.
WHAT CONSTITUTES 4TH DEGREE AGGRAVATED ASSAULT IN NJ?
It is a crime of the fourth degree if you commit an aggravated assault by recklessly causing injury to someone with a weapon. Moreover, it is also a fourth degree aggravated assault to recklessly point a gun in the direction of another person even if it is unloaded. If you are found guilty of a fourth degree felony, you can be sentenced to state prison for up 18 months, serve a period of probation, face up $10,000 in fines, and suffer a permanent criminal record.

Defense Strategies for Aggravated Assault Charges
Every aggravated assault case presents its own legal and factual challenges. Our skilled criminal defense attorney can investigate and develop strategies tailored to your case. Some examples of possible defense approaches include:
- Challenging intent – Prosecutors must often prove that you acted purposely, knowingly, or recklessly. If the injury was accidental or unintentional, you may not be guilty.
- Self-defense or defense of others – If you acted to protect yourself or someone else from harm, your attorney can argue that your actions were legally justified.
- Disputing the extent of injury – Many aggravated assault charges depend on how severe the injury is. Medical records and expert witnesses can challenge these claims.
- Questioning the use of a deadly weapon – The prosecution often must prove both possession and that you used it in a threatening or harmful manner.
- Identifying police or procedural errors – Unlawful arrests, Miranda violations, and lack of probable cause can be used to suppress evidence or challenge the case.
By exposing inconsistencies or alternative explanations, your attorney can strengthen your position during plea negotiations or at trial.
