Every simple assault charge that Union City police or a complaining witness files is prosecuted under N.J.S.A. 2C:12-1(a), and Union City Municipal Court decides it with a judge alone; there is no jury. The State can charge it three ways: trying to cause, or purposely, knowingly or recklessly causing, bodily injury; negligently injuring someone with a deadly weapon; or using physical menace to try to make someone fear imminent serious bodily injury. Ordinarily it is a disorderly persons offense (roughly what other states call a misdemeanor) which exposes you to a jail term of as long as six months and a fine as high as $1,000. If the evidence shows a fight or scuffle both people entered by mutual consent, the grade falls to petty disorderly persons, with a ceiling of 30 days and $500.
We are William Proetta Criminal Law, working from our Jersey City office at 242 10th Street, Suite 103. My own trial work in criminal courts now spans more than 15 years. In a city this compact, an assault case often turns on something small and close by: a doorway camera, a neighbor who heard the start of it, a text sent an hour earlier.
A Small City With Busy Borders
Union City covers about 1.29 square miles, and it is the only Hudson County municipality surrounded entirely by other Hudson towns: Hoboken, Jersey City, North Bergen, Weehawken and West New York. That geography produces a practical problem we check on every file. An incident a block away from where you think it happened can belong to a different police department and a different municipal court.
Kennedy Boulevard. For much of its length the boulevard forms Union City’s western line with North Bergen. Which side of the street an incident occurred on can decide which town’s officers responded and which courtroom has the case.
Bergenline Avenue. The city’s main commercial street runs north to south through all of Union City and continues into West New York and North Bergen. An address on Bergenline means little until we know the cross street.
The Transfer Station area. At the five-corner intersection of Summit Avenue, Paterson Plank Road and 7th Street, the city’s southern blocks are not far from neighboring towns. We confirm the jurisdiction on the summons against the actual location before we file anything.
Route 495 and the light rail. Route 495 crosses the city toward the Lincoln Tunnel, and the Bergenline Avenue light rail station sits at 49th Street. A person charged here may live in New York or another Hudson town.
Union City Police Department. Officers from the city’s own department respond to calls inside its borders and decide at the scene whether to sign a complaint. If they do not, the other person can still walk into the municipal court and ask to file one. A judge or authorized court administrator must find probable cause before that citizen complaint issues, and for a disorderly persons offense it generally must be filed within one year.
From Complaint to Courtroom
- Charging document. Many people receive a complaint-summons with a court date. A complaint-warrant means a booking and a release decision by a judge first.
- Notice. The court mails a written notice. The city’s court page says it holds a mix of in-person and Zoom sessions, so check whether your date is virtual or in the courtroom. The courtroom is on the 2nd floor of 3715 Palisade Avenue, Union City, NJ 07087.
- First appearance. You hear the charge and penalties. We enter a not guilty plea and request discovery: the police report, body-worn camera footage, 911 audio, photographs and any medical records.
- Prosecutor review. The Union City municipal prosecutor, not the complaining witness, controls the case once it is filed and decides what to offer.
- Trial or resolution. If no fair offer comes, the judge hears testimony and decides whether the State proved every element beyond a reasonable doubt. A related indictable charge sends the case to the Hudson County Prosecutor’s Office and the Superior Court at the Guarini Justice Complex, 24 Central Avenue, Jersey City.
The law itself, including what “bodily injury” means, is laid out on our Hudson County simple assault page.

When both people sign complaints after the same incident, the court hears them together.
Two Complaints From One Incident
After an argument turns physical, both people sometimes sign complaints, and the court hears them together. Paired complaints sometimes end with both being dropped, yet every sentence of the complaint you signed is evidence the other side can use. Where one prosecutor cannot fairly handle both sides, the court may allow a private attorney to present one complaint after a motion and a finding of conflict. Our guide to mutual fight assault explains why the State must disprove mutual consent once the evidence raises it.
If the Other Person Is a Partner, Relative or Roommate
When the complaining witness is a spouse or former spouse, a dating partner, a co-parent, or a present or former household member, the case falls under the Prevention of Domestic Violence Act (N.J.S.A. 2C:25-19). Roommates count as household members. That changes several things:
- Officers must arrest when they find probable cause and the victim shows signs of injury (or a weapon, an outstanding warrant or a restraining order violation is involved).
- A temporary restraining order may follow from the Hudson County Family Part, opening a second case with its own hearing.
- Conditional dismissal is unavailable.
- A conviction bars a firearms purchaser ID card, and federal law separately bars gun possession after a domestic violence conviction.
- The complainant cannot simply withdraw; the prosecutor decides.
Our Hudson County domestic violence page covers the restraining order side.
Noncitizens: Get Immigration Advice Before Any Plea
For a person who is not a U.S. citizen, a simple assault conviction can carry immigration consequences, and the risk can be greater when the case is domestic. Federal law defines “conviction” on its own terms, so a plea entered to qualify for a diversion program may still count. Speak with an immigration lawyer before you plead to anything. Our page on domestic violence immigration consequences explains the main concerns.
Ending the Case Without a Conviction
Conditional dismissal under N.J.S.A. 2C:43-13.1 is a one-time program for defendants with no prior conviction and no earlier diversion. The judge weighs whether the offense was assaultive or violent, and cases against elderly, disabled or minor victims are excluded along with domestic cases. After a year of probation monitoring without new trouble, the charge is dismissed. An outright dismissal can be expunged right away, a conditional dismissal six months later, and a disorderly persons conviction generally after five years.
Defense Angles We Examine
- Self-defense or defense of another person, which the State must disprove once raised.
- Mutual consent, which lowers the grade.
- No bodily injury: no pain described, no photos, no treatment.
- Who struck first, as shown on phone or doorway video.
- A witness with a motive, such as a lease or custody dispute.
- Wrong town on the paperwork.
If a plea makes sense, we ask for a civil reservation so the plea cannot be used against you in a civil lawsuit.
