A simple assault charge in Sayreville is brought under N.J.S.A. 2C:12-1(a). In most cases it is a disorderly persons offense (loosely, New Jersey’s version of a misdemeanor), with exposure of up to six months in jail and a fine as high as $1,000. If the proof shows a fight or scuffle that both people chose to enter, the grade falls to petty disorderly persons, where the ceiling is 30 days and $500. Either way the complaint is decided by a judge, without a jury, at Sayreville Municipal Court, 1000 Main Street, Sayreville, NJ 08872.
We defend Sayreville clients from the William Proetta Criminal Law office in Edison, 3840 Park Ave, Suite 202A. I have more than 15 years of criminal trial experience, and much of what decides a Sayreville assault case happens before anyone testifies: what the officers recorded, who filed first, and whether the other side has its own complaint pending. In our experience, most simple assault complaints out of Sayreville grow out of a home, involving partners, relatives or roommates rather than strangers.
Where Sayreville Assault Complaints Begin
Sayreville is a borough of several distinct sections, and a complaint may name one of them: Parlin, Morgan, Melrose, Ernston or Sayre Woods, among others. The Sayreville Police Department, headquartered at the same 1000 Main Street address as the court, signs many of the complaints that reach this courtroom. Route 9, Route 35 and the Garden State Parkway all pass through the borough.
Three local details matter more than people expect:
- Parlin is not always Sayreville. The Parlin postal name covers parts of both Sayreville and Old Bridge. An incident at a Parlin address is heard in Sayreville only if it happened inside the borough. Your complaint names the court; trust that, not the mailing address.
- The bridges are borders. The Edison Bridge, the Driscoll Bridge and the Victory Bridge cross the Raritan into Sayreville. A road-rage confrontation that started on one side and ended on the other is charged where the alleged contact happened.
- Commuters get charged here too. Someone driving through on the Parkway or waiting for an NJ Transit bus to Port Authority can get a Sayreville court date while living elsewhere.
When It Is Domestic Violence
Given how many Sayreville cases start at home, this branch deserves attention early. Under N.J.S.A. 2C:25-19 the same charge is domestic violence when the two people are spouses or former spouses, dating partners, parents of a child together, or present or former household members, a group that includes a roommate you live with now or lived with before. Officers responding to a Sayreville home must arrest if they have probable cause and see signs of injury. After that, several things change: a temporary restraining order can come with the complaint, issued at night by a municipal judge through the police, with the final hearing in the Family Part in New Brunswick; conditional dismissal is barred; the order can require police to take your guns, and a conviction brings state and federal firearm consequences; and the person who called cannot simply drop the complaint. Our page on domestic violence simple assault covers PTI and the rest.
How a Simple Assault Case Moves Through Sayreville Municipal Court
Two ways a complaint is signed. If officers respond and believe they have enough, they sign it and hand you a summons with a court date. If they decline, the other person can go to the court window and file a citizen complaint; it issues only after a judge or court administrator finds probable cause.
The first listing. The court sends Zoom details by email when a session is scheduled as virtual, and first appearances are commonly held that way. The judge reads the charge, describes the penalties and confirms you have counsel. We enter a not guilty plea.
Discovery. We send the municipal prosecutor a written request for the incident report, body-worn camera footage, the 911 recording, photographs and witness statements. Parking-lot cameras and bystander phone video can be decisive, so we ask before anything is overwritten.
Resolution or trial. Any agreement must be stated on the record, the prosecutor must represent that the victim, if present, was consulted, and the judge can reject a deal that does not serve justice. Without one, the case is tried before the judge.
When it leaves the borough. If the injury alleged is significant or serious, the complaint is aggravated assault and goes to the county prosecutor in New Brunswick. Sometimes the reverse happens: an aggravated charge is downgraded by that office and sent back to Main Street.

Mutual Fights and Cross-Complaints
Some Sayreville cases have two defendants, each the complaining witness against the other. The court often lists both complaints for the same date. Each side then has a reason to settle, but anything you say about your own complaint can be used in the one against you.
A mutual fight is also a grading question. When the evidence points to a consensual scuffle, the burden shifts to the State to rule that out beyond a reasonable doubt; if it cannot, the petty disorderly grade is the ceiling. Our page on mutual fight assault explains that rule.
Conditional Dismissal and Expungement
For a first offense that is not domestic, conditional dismissal under N.J.S.A. 2C:43-13.1 is often the goal. You must have no prior conviction and no earlier diversion. You apply after a plea or finding of guilt, before judgment, and the judge weighs factors including whether the offense was assaultive or violent. After a year of monitoring with no new trouble, the charge is dismissed. The program is barred where the alleged victim is elderly, disabled or a minor.
A conditionally dismissed charge can be expunged six months after the dismissal; a disorderly persons conviction generally requires five years. Our expungement page explains the process.
Defenses We Use in Sayreville Cases
- Justified force. Self-defense, or defense of someone else, applies where you reasonably believed force was immediately needed; the State must disprove it once raised.
- Consent to the fight. Even short of acquittal, proof of a mutual scuffle caps the grade.
- No bodily injury. A charge of causing injury needs proof of physical pain or impairment, not just an accusation.
- Wrong person. In a crowd or a busy lot, identification can be mistaken.
- Who is believable. Prior texts, a pending custody or landlord dispute, and the timing of the complaint all bear on credibility.

Sayreville Simple Assault FAQs
Where is Sayreville Municipal Court?
At 1000 Main Street, Sayreville, NJ 08872, the same address as police headquarters. Check your notice for whether your date is in person or by Zoom.
My complaint lists a Parlin address. Will the case be in Sayreville?
Only if the incident happened inside the borough. Part of Parlin lies in Old Bridge, so the court printed on the complaint controls.
The other person signed a complaint against me at the court window. Can I file one too?
You can, if you have a truthful basis. Talk to a lawyer first, because filing puts your own account on record.
I was charged after a fight on the sidelines of a youth game in Sayreville. Is that still simple assault?
Not necessarily. Under N.J.S.A. 2C:12-1(f), an assault committed in the presence of a child under 16 at a school or community sponsored youth sports event becomes a fourth-degree crime, which goes to the county prosecutor. We check which subsection the complaint cites.
Can the person who called police drop the Sayreville charge?
Not on their own. Once a complaint is filed, the municipal prosecutor decides, though the complaining witness is heard.
Is simple assault a criminal record in New Jersey?
A disorderly persons conviction is not a crime under state law, but it is a public conviction that background checks find until it is expunged.
