In South Plainfield, simple assault is charged under N.J.S.A. 2C:12-1(a), and the usual grade is a disorderly persons offense (a category many other states would file under misdemeanors): the maximum sentence is 6 months behind bars plus a fine up to $1,000. The statute carves out one lower tier. When the incident was a fight or scuffle that both sides entered willingly, it is a petty disorderly persons offense, punishable by no more than 30 days and $500. Both grades stay out of the Superior Court and are tried before the judge at South Plainfield Municipal Court, 2480 Plainfield Avenue.

I am William A. Proetta, and William Proetta Criminal Law defends borough residents and visitors from our office in neighboring Edison, 3840 Park Ave, Suite 202A. In more than 15 years of criminal trial practice, I have found that assault cases often turn on evidence that existed in the first hour: a phone video, a 911 call, or the first thing someone told an officer. Something else we see consistently: the majority of the borough’s simple assault complaints that come to us began inside a residence, between partners, relatives or people sharing a house.

South Plainfield Geography That Shapes a Case

The South Plainfield Police Department writes many of the assault complaints filed in its court.

Retail along Hadley Road and Hamilton Boulevard. The shopping centers around Hadley Road, Stelton Road and Hamilton Boulevard can draw customers from other towns, so the person charged in the borough may not live there at all.

Highway traffic. Interstate 287 crosses the southern part of the borough with exits 4 and 5. A roadside confrontation is charged where the contact happened, which can mean a South Plainfield court date for someone only passing through.

Residential sections. Avon Park, Holly Park and Samptown are among the borough’s named sections, and an incident in any of them goes to the same borough court.

Youth sports events. Under N.J.S.A. 2C:12-1(f), an assault in the presence of a child younger than 16 at a school or community sponsored youth sports event is a fourth-degree crime.

The Piscataway line. Stelton Road and New Durham Road follow the border with Piscataway, and Edison lies to the east. An argument on the wrong side of the road belongs to a different court. The court named on your complaint controls, and we confirm it at the start.

When It Is Domestic Violence

Because that is where most South Plainfield complaints come from, this track usually shapes the whole defense. An assault here falls under the Prevention of Domestic Violence Act, N.J.S.A. 2C:25-19, when the people involved are spouses or former spouses, co-parents, dating partners, or anyone who lives in the household or once did, roommates included. Officers must arrest when they have probable cause and see signs of injury, and they can seize weapons. What follows differs from an ordinary assault: the accuser can obtain a temporary restraining order, with the final hearing in the Family Part in New Brunswick on its own schedule; conditional dismissal is closed off; the order can require you to give up firearms, and a conviction brings state and federal gun consequences; and an accuser who changes their mind cannot end the complaint alone, since the municipal prosecutor decides. See our page on domestic violence simple assault for PTI and the rest.

How a Simple Assault Case Moves Through South Plainfield Municipal Court

Getting charged. Police who respond to a call and find probable cause sign the complaint and release you with a summons. When they decline, the other person can apply for a citizen complaint at the court office, and a judge or court administrator decides whether it should issue.

A Wednesday court. The borough court lists its sessions on the first through fourth Wednesdays of each month, with a 9 a.m. and a 1 p.m. calendar, and it provides a form to request a Zoom link. First appearances are often virtual. At that first date the judge explains the charge and penalties, and we enter a not guilty plea.

Language help. The court’s page lists a separate line for Spanish-language assistance, (908) 226-7650. The Judiciary provides interpreters in other languages too; request one early through the number on your notice.

Building the file. We serve a discovery request on the municipal prosecutor for reports, body-worn camera video, the 911 recording, photographs and any written statements. If a store camera or a neighbor’s doorbell caught the incident, we move to preserve it.

Outcome. A negotiated result has to be placed on the record and accepted by the judge, and at any guilty plea we ask that it not be evidential in a civil suit. If there is no agreement, the case goes to trial before the judge, generally in person.

When the case leaves the borough. If the complaint alleges significant or serious injury, a weapon or a protected victim, it is an indictable aggravated assault, screened by the county prosecutor in New Brunswick. That office can also downgrade a charge and send it back to the borough court.

Mutual Fights and Cross-Complaints

Two people who both called 911 can both end up charged. When each files against the other, the court often schedules the two complaints together, and each defendant becomes the other’s key witness. Filing a complaint of your own can shift the negotiation, but it also commits you to a sworn account; it should never be a reflex.

A consensual scuffle is a separate issue from who started it. If the evidence suggests both people agreed to fight, the prosecution has to disprove mutual consent beyond a reasonable doubt to keep the disorderly persons grade. Our page on mutual fight assault goes through that standard.

Conditional Dismissal and Expungement

Conditional dismissal under N.J.S.A. 2C:43-13.1 is the main diversion for a first offense. Eligibility requires no earlier conviction and no previous diversion program; domestic violence cases and cases with an elderly, disabled or minor victim are excluded. The application follows a plea or finding of guilt and precedes judgment, and the judge considers whether the conduct was assaultive or violent. Complete a year of monitoring and the charge is dismissed.

Six months after that dismissal, the record can be expunged. A disorderly persons conviction usually requires a five-year wait. Our page on Middlesex expungement explains the filing.

Ways We Fight the Charge

  • Self-protection. Force used because you reasonably believed it was immediately necessary is justified, and the State carries the burden to disprove it.
  • Agreed fight. Mutual consent reduces the case to petty disorderly persons.
  • No pain, no impairment. If there is no credible proof of bodily injury, an injury-based charge fails.
  • The wrong person. In a crowded parking lot, eyewitnesses can confuse one person for another.
  • Motive and inconsistency. A neighbor feud or a breakup can give an accuser a reason to exaggerate.

South Plainfield Simple Assault FAQs

What day does South Plainfield Municipal Court hear cases?

Sessions run on Wednesdays, the first through fourth of each month, at 9 a.m. and 1 p.m. Your notice gives your exact date and whether it is by Zoom.

The incident happened on Stelton Road. Is it a South Plainfield case?

Only if it happened on the South Plainfield side. Stelton Road runs along the Piscataway border, and the complaint names the correct court.

I speak Spanish. Can I get help with my South Plainfield court date?

Yes. The court lists a Spanish-language assistance line, (908) 226-7650, and interpreters are provided for hearings.

The other driver says I hit him after we exited I-287. I live out of state. Do I have to come back?

The case must be resolved in South Plainfield. Counsel can cover some dates, but the judge decides when you appear, especially for a plea or trial.

Can a simple assault complaint be dismissed if the other person stops cooperating?

Possibly, but the decision belongs to the municipal prosecutor, not the complaining witness.

Is simple assault a felony?

New Jersey does not use that term. It is a disorderly persons offense, not a crime, but a conviction remains public until expunged.
