Why a Few Xanax Is Still a Crime

People are often shocked that a couple of anxiety pills borrowed from a friend can lead to the same charge as cocaine. The reason is that New Jersey’s possession statute does not distinguish among Schedules I through IV. Xanax sits on Schedule IV, so it falls into the same third-degree category. What the law does recognize is the difference between a person with a valid prescription and one without, which is why prescription records are often the first thing we request.

Sharing, Selling and the Distribution Charge

Because Xanax is not a narcotic, distribution is not graded by weight. Selling or intending to sell any amount is third degree, with a fine of up to $25,000. That still exposes a person to three to five years, and it changes the immigration picture dramatically. One important limit on the State: under State v. Morrison, 188 N.J. 2 (2006), people who buy drugs together for their own shared use are joint possessors, not distributors. Friends who split a purchase are not dealing to each other, and that distinction can move a case from a sale charge back to simple possession.

Fake Bars and Loose Pills

Xanax Charges in Hoboken, Jersey City and Hudson County

Many Xanax arrests in Hudson County happen at night. Hoboken and Jersey City police encounter loose pills during bar-district disturbances, pat-downs and car stops on the way home, often alongside other charges. The pills are usually sent to the lab while the case sits in Superior Court, and the possession count may be amended down to a container offense in Hoboken or Jersey City Municipal Court once a prescription is documented. Penalties

Third-degree Xanax possession carries a range of three to five years in prison and a top fine of $35,000, with a presumption against prison for first offenders. A conviction brings the mandatory $1,000 DEDR penalty, a lab fee and possible driver’s license suspension. A distribution conviction carries the same prison range and a fine of up to $25,000.

Alternatives to a Conviction

Xanax possession by someone with no record is a strong fit for Pretrial Intervention, which leads to dismissal after a period of supervision. If the charge is reduced to a container violation, a conditional discharge may be possible in municipal court. For people with a benzodiazepine dependence who are otherwise facing prison, Recovery Court is an option. A prescription you simply did not have on you can make all of this unnecessary.

Arrest and Pretrial Release

Simple Xanax possession is usually charged on a summons, so most people are released from the station with a court date. A sale allegation, a large quantity or pills that test as fentanyl are more likely to bring a complaint-warrant and a first appearance within 48 hours. A Xanax possession conviction counts as a controlled substance offense for immigration purposes and can make a non-citizen removable. A sale conviction, even for a small number of pills, can be treated as an illicit trafficking aggravated felony. Showing that pills were shared rather than sold, or that they were lawfully prescribed, can protect a client’s status. • Lab confirmation. A bar’s shape and imprint do not prove its contents; only testing does.
• Shared use, not sale. Joint purchasers for personal use are possessors, not distributors.
• Nightlife searches. Pat-downs outside bars and searches of purses or cars must meet constitutional limits.
