Simple assault in Old Bridge Township is charged under N.J.S.A. 2C:12-1(a). As a disorderly persons offense (the category that comes closest to a misdemeanor elsewhere), its maximum sentence is six months in jail plus a $1,000 fine; when the incident was a fight both people agreed to, it is a petty disorderly persons offense with a 30-day, $500 cap. Either way it is not a crime under state law, and the case belongs to the township’s municipal court at One Old Bridge Plaza (ZIP 08857), where a judge, not a jury, decides it.
William Proetta Criminal Law handles Old Bridge assault cases from our office at 3840 Park Ave, Suite 202A in Edison. My 15-plus years in criminal trial courts have taught me that these cases can turn on small facts: who stepped forward first, what the camera caught, and what each person told the officer in the first ten minutes. Most Old Bridge simple assault files that reach our office involve family rather than strangers: a husband or girlfriend, a parent or sibling, or a housemate under the same roof.
Domestic Cases in Old Bridge
Since most of these cases come out of a household, start here. N.J.S.A. 2C:25-19 treats the charge as domestic violence when the two people are married or divorced, share a child, dated, or are present or former household members, which takes in adults who rent rooms in the same house now or did in the past. Four things follow. The complaining witness can get a temporary restraining order through the police that night or from the Family Part in New Brunswick, leaving you with two cases on two schedules; conditional dismissal is off the table; a restraining order can have your weapons seized, and a conviction disqualifies you from a firearms purchaser card and makes later gun possession a crime; and making up does not end the charge, because only the municipal prosecutor can dismiss it. Officers must arrest when they see signs of injury and have probable cause, and no mediation is allowed. See our page on domestic violence simple assault.
Old Bridge: A Large Township With Many Starting Points
Old Bridge covers a lot of ground, from the Raritan Bay shoreline at Laurence Harbor to the inland neighborhoods of Madison Park, Brownville, Browntown, Cheesequake and Sayre Woods South. Route 9 and Route 18 cut through it north to south, with Route 34, Route 35, County Road 516 and the Garden State Parkway carrying traffic across. There is no train station in the township, so many commuters use the Old Bridge Park & Ride on Route 9 northbound and NJ Transit buses.
The department behind many complaints. The Old Bridge Police Department has its administration at One Old Bridge Plaza, the same municipal complex as the courtroom. Patrol officers answering a call decide whether to sign a complaint, and if they do, the summons usually directs you back to that same building.
Away from home. The other complaints tend to follow an argument between neighbors or a confrontation that spills out of a parking lot. When the person charged is under 18, the matter goes to the Family Part in New Brunswick instead.
Check the town on the summons. Parlin straddles Old Bridge and Sayreville. An incident at an address marked Parlin belongs to whichever township the spot actually lies in, and that decides which municipal court hears it. We confirm this before anything else.
Citizen complaints. If police decline to charge, the other person can go to the Old Bridge court and ask to file. A judge or authorized court officer must find probable cause before the complaint issues, and it has to be filed within a year of the incident.
How a Simple Assault Case Moves Through Old Bridge Municipal Court
The process often begins with a summons. If police instead obtained a complaint-warrant, the defendant sees a judge by video from the county jail and is released on conditions. The first court date at One Old Bridge Plaza is an arraignment. Initial appearances are generally conducted virtually, and you will hear the charge, the maximum penalty and your right to counsel. We enter a plea of not guilty and send the Old Bridge municipal prosecutor a written discovery request for the incident report, body-worn camera and dash video, the 911 call, photographs and medical records.
Next comes negotiation. The prosecutor speaks with the complaining witness but makes the decision; a witness who has calmed down cannot simply drop a filed complaint. If no fair resolution is offered, the judge holds a trial, usually in person, and the State must prove each element beyond a reasonable doubt. A related indictable charge, such as an aggravated assault count, can move the case to the Superior Court in New Brunswick.

Fights With Two Sides
Some Old Bridge complaints come in pairs. After one person files, the other may sign a cross-complaint, and the court hears them together. That can push both sides toward a mutual dismissal, but every word in your complaint becomes evidence. If the municipal prosecutor has a conflict in presenting both complaints, the court may allow a private attorney to prosecute one of them after a formal review.
Where the evidence shows a consensual fight, the State must prove it was not mutual, and the petty grade can be the realistic floor. Minor disputes without injury between neighbors can also be referred to municipal court mediation.
Diversion, Record Clearing and the Statute
The three forms of the offense, the meaning of “bodily injury” and the line where a case becomes aggravated assault are covered on our Middlesex simple assault page.
Conditional dismissal is the main municipal diversion program. It is open once to a person with no prior conviction and no earlier diversion. The judge considers whether the offense was violent, and domestic cases and cases with a complainant who is elderly, disabled or a minor are excluded. After a year of monitoring the charge is dismissed. A dismissed charge can be expunged, and a disorderly persons conviction usually after five years; our expungement page explains the timing.
Defending an Old Bridge Charge
- Self-defense: you may meet unlawful force with force you reasonably believed necessary.
- A mutual fight: consent lowers the grade even without an acquittal.
- Menace that was not imminent: shouting from across a lot is generally not an (a)(3) assault.
- No pain reported at the scene, and no photographs or treatment.
- Identification problems in a crowd.
- Bias and motive: a property line dispute or custody fight can explain a complaint.
If a plea is the right answer, we request a civil reservation at the plea so it cannot be used against you in a lawsuit.
