Perth Amboy police and the city court treat simple assault as an N.J.S.A. 2C:12-1(a) offense, and it is usually graded as a disorderly persons offense (what many other states would treat as a misdemeanor): a judge may impose as much as 6 months in jail and a $1,000 fine. A fight that both sides entered by mutual consent is graded lower, as a petty disorderly persons offense capped at 30 days and $500. New Jersey does not count either one as a crime. The complaint is heard without a jury at Perth Amboy Municipal Court, 361 New Brunswick Avenue, Perth Amboy, NJ 08861.
Our firm, William Proetta Criminal Law, represents people charged in Perth Amboy from the Edison office at 3840 Park Ave, Suite 202A, and our staff speaks Spanish. I have tried criminal cases for more than 15 years, and a Perth Amboy assault charge can come down to two or three witnesses whose accounts do not match. Most of the simple assault charges we defend in the city court come from inside a household rather than the street: partners and exes, relatives, people renting rooms together.
Perth Amboy’s Court, Police and Neighborhoods
Two addresses on one avenue. The Perth Amboy Police Department is at 365 New Brunswick Avenue, and the municipal court is at number 361 on the same street. Officers who answer a call write the report and, when they find probable cause, sign the complaint that the court down the avenue will hear.
The court’s calendar. The city court lists in-person sessions on Tuesday and Thursday mornings at 9:00 and Wednesday afternoons at 1:30, with virtual sessions on Tuesday and Thursday at 4:00 p.m. The court posts a virtual hearing form, with instructions for remote proceedings in both English and Spanish. Your notice tells you which session you are on and whether you must come in.
Language. A defendant or witness who prefers to speak Spanish or another language can ask for an interpreter. The New Jersey Judiciary provides court interpreters, and the court should be told ahead of time, at the number on your notice, if you need one. We review whether any statement you gave police was taken in a language you fully understood.
Where cases start. Perth Amboy is a compact city of about 55,000 people. Apart from household disputes, a complaint can begin between neighbors, at work or on the street, and the patrol officers who answer the 911 call decide whether to sign it.
Visitors from across the bridges. The Outerbridge Crossing connects the city to Staten Island and the Victory Bridge carries Route 35 to Sayreville, so the person charged is sometimes from New York or a neighboring town. The case still stays in Perth Amboy.
Citizen complaints. When officers do not charge, a person who says they were assaulted can ask the court to issue a complaint. A probable cause finding by a judge or authorized court officer comes first, and the filing generally must happen within one year.
If the Complaint Involves a Partner or Family Member
This is the branch most Perth Amboy cases take. N.J.S.A. 2C:25-19 reaches spouses and former spouses, co-parents, dating partners and anyone who lives in the household or ever did, so a roommate, or a cousin who once shared the apartment, is covered. Once that label applies, the other person can obtain a temporary restraining order from the Family Part in New Brunswick, a case that runs apart from the city court; conditional dismissal is unavailable; the order can require you to give up firearms, and a conviction carries state and federal firearm consequences; and the complaining witness cannot call the case off, since the city’s municipal prosecutor decides. Arrest is mandatory when officers see signs of injury and have probable cause. Read more on our domestic violence simple assault page.
Immigration Concerns
Many of the people we represent in Perth Amboy’s court ask about immigration first, often before they ask about jail. The worry is fair. A domestic violence conviction can expose a noncitizen to removal under federal law, and whether a particular simple assault plea counts may turn on which subsection is named, what intent the plea admits and whether the record identifies the complainant as a partner or household member. Separately, a judge’s finding that a restraining order’s protective terms were violated can create removal risk without any criminal conviction. The U.S. Supreme Court held in Padilla v. Kentucky, 559 U.S. 356 (2010), that a defense lawyer must warn a client when a plea may lead to deportation. Our practice is to have the client’s immigration attorney read the proposed plea and factual basis before anything is entered. See our page on domestic violence immigration consequences.
How a Simple Assault Case Moves Through Perth Amboy Municipal Court
- Summons or warrant. A summons gives a date at 361 New Brunswick Avenue. A complaint-warrant means a video first appearance from the county jail and release conditions.
- Arraignment. The judge explains the charge and the possible penalties. First appearances are generally held virtually.
- Evidence. We request the police report, body-worn camera footage, the 911 audio and any photographs from the municipal prosecutor in writing.
- The prosecutor’s decision. The city’s municipal prosecutor, not the complaining witness, decides whether to dismiss, amend or try the charge.
- Trial. The judge hears testimony, with an interpreter where needed, and rules.
If police allege a serious injury, the charge may instead be aggravated assault, which goes to the county prosecutor and the Superior Court in New Brunswick.

Mutual Fights and Cross-Complaints in the City Court
Each person may sign a complaint against the other, and the court hears them together. A mutual dismissal is sometimes possible, but filing your own complaint locks your version in writing. If the municipal prosecutor has a conflict in handling both sides, the court may approve a private prosecutor for one of them. Evidence of a consensual fight shifts the burden to the State to show it was not mutual, which can bring the grade down to petty disorderly.
Conditional Dismissal, Expungement and the Statute in Brief
Pain by itself counts as injury, and our Middlesex County simple assault page covers each form and sentencing.
A person with no prior conviction and no prior diversion can apply once for conditional dismissal. After a year of monitoring the charge is dismissed. Domestic cases are excluded, as are cases with a minor, elderly or disabled complainant, and the court weighs whether the offense was violent. A dismissal can be expunged, while a disorderly persons conviction generally needs five years.
Our Defense in Perth Amboy Cases
- Justified force. Self-defense, or defense of a family member, that the State cannot disprove.
- A fair fight. Mutual consent reduces the charge to petty disorderly.
- Who did it. Street and crowd incidents raise real identification issues.
- Translation. A statement taken without a proper interpreter may be challenged.
- No injury. No pain reported, no treatment and no photographs.
- Civil exposure. At any plea we ask the judge for a civil reservation.
