Piscataway simple assault charges are written under N.J.S.A. 2C:12-1(a). Most are disorderly persons offenses (comparable to a misdemeanor in many other states), punishable by up to six months behind bars and up to $1,000 in fines. If the evidence shows a fight that both people agreed to, the offense is petty disorderly persons instead, with a 30-day and $500 limit. Because neither is a crime under New Jersey law, a municipal judge decides the case at Piscataway Municipal Court, Public Safety Building, 555 Sidney Road, Piscataway, NJ 08854.

We are William Proetta Criminal Law. Our Edison office at 3840 Park Ave, Suite 202A takes Piscataway cases, including cases involving Rutgers students and their families. My experience over 15-plus years of trials is that Piscataway assault cases can be decided by video and by what witnesses said before they had time to think. Rutgers draws the attention, but in our experience most Piscataway simple assault complaints are domestic: a dating partner, a family member, or a roommate in a shared house or apartment.

Domestic Relationships

In Piscataway the domestic label reaches further than many students expect. N.J.S.A. 2C:25-19 covers spouses, ex-spouses, co-parents, people who dated, and present or former household members, so roommates who share a house or apartment, or used to, can fall within it. Then the case changes: a temporary restraining order can come with the charge, with the final hearing set in the Family Part in New Brunswick; conditional dismissal, often a student’s best route, is barred; the order can require you to surrender firearms, and a conviction carries state and federal firearm consequences; and a roommate or partner who regrets calling cannot withdraw the complaint, which belongs to the municipal prosecutor. Police must arrest when they find probable cause and signs of injury, and mediation is not permitted. Our page on domestic violence simple assault explains the separate track.

Piscataway: Township Neighborhoods and Two Rutgers Campuses

The Sidney Road building. The Piscataway Police Department and the municipal court share the Public Safety Building at 555 Sidney Road. Township officers who answer a call take statements, photograph any injuries and decide whether to sign a complaint; the summons then sends you back to the same building.

Rutgers in the township. Busch Campus lies entirely within Piscataway, and most of Livingston Campus does too, though Livingston extends into parts of Edison and Highland Park. Rutgers has its own police department, whose commissioned officers have full arrest powers, so an incident on campus may be investigated by university police rather than township officers. Either way, a disorderly persons charge from a Piscataway location is usually heard on Sidney Road, not in New Brunswick. The exact location matters: a Livingston address on the Edison side goes to Edison’s court.

Students and parents. A student charged with assault can face two separate processes. The municipal case decides guilt under state law. Rutgers says its student conduct code applies to off-campus behavior as well, so a university inquiry may follow on its own track. When a parent calls us, we speak with the student directly and advise against giving any statement to the university before talking with a lawyer.

The rest of Piscataway. Many complaints have nothing to do with the university; besides household disputes, they can grow out of a quarrel between neighbors or co-workers, or an argument in a parking lot. When the person charged is a minor, the case goes to the Family Part in New Brunswick.

Getting there. The township has no train station; NJ Transit buses serve it. Students without a car should plan the trip to Sidney Road for any in-person listing.

How a Simple Assault Case Moves Through Piscataway Municipal Court

The case starts in one of two ways. Officers sign a complaint after a 911 call, or a private person asks the court to issue one; for a citizen complaint, a judge or authorized court officer must first find probable cause, and it generally must be filed within a year.

Many people receive a summons and a date. If a complaint-warrant was issued, the first appearance is by video from the county jail. At arraignment, generally held virtually, the judge reads the complaint and states the maximum penalties, and we plead not guilty for you. We then demand discovery in writing from the Piscataway municipal prosecutor: the reports, body-worn camera and any Rutgers police video, 911 recordings, photographs and witness names.

The municipal prosecutor controls the case and considers the complaining witness’s wishes without being bound by them. Cases resolve by dismissal, amendment, conditional dismissal or trial before the judge. An indictable charge from the same incident can draw the case into the Superior Court.

The court depends on where the incident happened, not which department signed the complaint. An indictable charge from the same incident can draw the case into the Superior Court.

Cross-Complaints and Mutual Fights

Roommate and neighbor disputes can produce two complaints, one from each side, and the court hears them together. A cross-complaint can bring the other side to the table, but it also creates a sworn record of your account, so we decide on it carefully. If the municipal prosecutor cannot fairly prosecute both complaints, a private prosecutor may be approved for one.

Once the evidence suggests a consensual fight, the State bears the burden of proving it was not mutual, and the petty grade becomes a realistic result. Our page on the mutual fight assault rule explains how that works. Minor disputes without injury may be referred to municipal court mediation.

Conditional Dismissal and Clearing the Record

The full statute, including bodily injury, physical menace and the step up to aggravated assault, is laid out on our Middlesex County simple assault page.

For a student with a clean record, conditional dismissal is often the goal. It requires no prior conviction and no earlier diversion, lasts one year, and ends in dismissal. The judge looks at whether violence was involved, and the program is closed to domestic matters and to cases where the complainant is a child, elderly or disabled. Expungement is available for a charge dismissed outright right away, six months after a conditional dismissal, and for a disorderly persons conviction generally after five years, as our Middlesex expungement page explains.

  • No bodily injury: no pain reported, no treatment, no photos.
  • Misidentification at a crowded party or gathering.
  • Credibility: group chats, messages and video from phones and building cameras.

Piscataway Simple Assault FAQs

I was charged on Busch Campus. Is my case in New Brunswick?

Usually not. Busch is in Piscataway, so a disorderly persons charge is heard at Piscataway Municipal Court on Sidney Road.

Rutgers police charged me, not Piscataway police. Does that change the court?

No. The court depends on where the incident happened, not which department signed the complaint.

Will Rutgers find out about a Piscataway assault charge?

Possibly. Rutgers states that its code of student conduct reaches behavior off campus too, and that process runs apart from the court case.

My roommate filed against me. Can I file back in Piscataway?

Yes, by asking the court to issue a citizen complaint; a judge or court officer must find probable cause. Talk with us before you file.

Can a parent handle the case for a student?

A parent can help and call us, but the student is the defendant and must take part.

Can I get conditional dismissal for a first assault charge?

It may be available if this is your first offense, you have never been in a diversion program and the case is not domestic.
