South River Municipal Court is on the second floor of the municipal building at 61 Main Street, which also houses the South River Police Department. Most hearings are scheduled by Zoom on Wednesday evenings starting at 5:00 p.m., and in-person dates are held in a particularly small courtroom. The court hears disorderly persons offenses, DWI and traffic charges and borough ordinance violations; indictable charges go to Middlesex County Superior Court in New Brunswick. Parking & Arrival
The court office and courtroom are on the second floor at 61 Main Street. Review posted downtown parking restrictions and allow additional time to park and reach the courtroom.
When to arrive: Allow approximately 20–30 minutes before any required in-person appearance for parking, security and check-in. This is practical planning advice, not a court-mandated arrival time.

What to Expect When You Appear in Person in South River
Take the stairs or the elevator to the second floor of the municipal building. There you will find a small waiting area, and to go further you pass through security run by South River police, with a metal detector and a table to check your belongings. The door to the prosecutor’s office is immediately to the right of the security checkpoint.
The prosecutor usually meets with attorneys as a group, separately from people representing themselves. When a case is resolved, a court officer hands the file to the judge. The courtroom is particularly small, with only a couple dozen seats, so it is common to see people standing in the hallway waiting their turn.
When your matter is finished, the violations window is on your right as you leave the courtroom, where you can pay fines and assessments. Having a lawyer means your case is worked out in the attorneys’ conference rather than while you wait in a crowded hallway.
Charges Heard in South River Municipal Court
South River’s main roads, County Routes 527 and 535, carry traffic between Route 18 and the Turnpike, and many of the motor vehicle cases we defend there start on them: DWI, refusal to submit to a breath test, driving while suspended and reckless driving. The criminal complaints we handle in South River include simple assault, harassment and disorderly conduct, often filed by a neighbor or acquaintance rather than an officer, along with shoplifting, drug possession and drug paraphernalia.
Understanding Your South River Municipal Court Summons
A South River summons contains important information about the alleged offense including, the statute charged, the person or officer who issued the complaint, the location of court and when you are required to appear. The numbered areas below identify information worth carefully reviewing.
Key Information to Check
Court and Court Code
This identifies the municipality and court associated with the summons. For a case arising in South River, look carefully at the court information printed on your paperwork.
Summons or Complaint Number
This number identifies the individual summons or complaint. It may be needed when communicating with the municipal court or reviewing court records.
Complainant or Issuing Officer
The summons may identify the police officer or other complainant who issued or signed the charge, along with the involved police agency.
Date, Time and Location
These fields identify when and where the alleged offense occurred. They can also help identify potentially relevant police reports, video or other evidence.
Court Date and Time
Your summons may contain an initial appearance date. A later notice from the court can change that date or the manner in which the appearance will occur.
Where to Appear
Review the court location and appearance instructions carefully. Some proceedings may be conducted in person while others may be scheduled remotely.

Because South River schedules most hearings by Zoom and only some in person, check every notice for the format as well as the date. If a later notice changes the date, time or format, the newest notice is the one to follow. The court office is open weekdays from 9:00 a.m. to 4:00 p.m.
Virtual Court in South River
South River Municipal Court operates primarily through scheduled Zoom hearings, held in the evening. The court information above lists the current session schedule. Your notice tells you the date, time, and how to join.
A virtual hearing is still a court appearance. Missing it has the same consequences as missing an in-person date, and the judge expects the same conduct. See the FAQ below for what you’ll need.
What Happens After You Receive a Summons
- Payable traffic tickets. Many South River traffic tickets can be paid at NJMCdirect.com, by mail to 61 Main Street, or in person at the violations window on the second floor. Paying is a guilty plea, so points, MVC surcharges and insurance increases follow. If the ticket carries points, ask us first whether it can be amended to a lower-point or no-point offense.
- Time payments. If the court has set you up on a payment plan for traffic or criminal fines, you can make those payments through NJMCdirect as well.
- Appearance required. Criminal and disorderly persons complaints, including private citizen complaints, DWI and refusal, and tickets marked “court appearance required” must be heard by the judge, usually on the Wednesday Zoom calendar unless the court sets the matter in person.
- Contesting a charge. To plead not guilty, follow the instructions on your summons or notice. Your lawyer then requests discovery: police reports, body-worn camera footage, dash-cam video, witness statements, photographs, lab results, and Alcotest records. Your lawyer meets with the municipal prosecutor to try to resolve the case. Most cases end there through dismissal, a downgrade, or diversion. If the stop or search was unlawful, your lawyer can file a motion to suppress. If the case doesn’t resolve, the judge decides it at trial.
Private Citizen Complaints in South River
Not every South River case starts with an arrest or traffic stop. A neighbor, acquaintance, or family member can file a private complaint using the borough’s forms, which include a complaint information form and a certification in support of probable cause.
If a private complaint has been filed against you, it isn’t a finding of guilt. A judicial officer must find probable cause, and the case goes through the same process as any other charge. These cases often turn on credibility and context, so a lawyer can make a real difference.
DWI Cases in South River
South River DWI and refusal charges are decided by the municipal judge, without a jury, and early dates are often handled by Zoom. For defenses, penalties and the borough’s DWI numbers, see our South River DWI lawyer page.
When a South River Charge Goes to Superior Court
A South River complaint for an indictable crime, such as aggravated assault, burglary, theft over $200 or possession of most controlled substances, goes from Main Street to the Middlesex County Prosecutor’s Office in Superior Court in New Brunswick, about 15 minutes north on Route 18. If the prosecutor downgrades it, the case returns to South River’s Zoom calendar. Penalty ranges, conditional dismissal and PTI are covered on our Middlesex County criminal defense page.
Our Edison Office and South River Cases
