Our office recently represented a young man who was charged with Possession of Marijuana in an amount less than 50 grams. At the time of his arrest he was situated on the beach in a popular Ocean County shore town when he was allegedly approached by police who began to interrogate our client, specifically in a manner designed to illicit incriminating responses. The results of the interrogation, which took place before our client was arrested and without a proper issuance of Miranda Rights led to his arrest. By way of a motion to suppress physical evidence and statements, we were able to successfully argue that the interrogation was unlawful as the police did not have probably cause to search our client, and interrogated him unlawfully without Miranda warnings. The end result was a dismissal of the charges.
