Superior Court vs. Municipal Court in Ocean County

New Jersey splits criminal charges by seriousness. Indictable crimes carry a possible state prison sentence and can only be resolved in Superior Court. The ranges under N.J.S.A. 2C:43-6 are:

  • Fourth degree: up to 18 months
  • Third degree: 3 to 5 years
  • Second degree: 5 to 10 years
  • First degree: 10 to 20 years

Disorderly persons and petty disorderly persons offenses (simple assault, harassment, shoplifting under $200, possession of drug paraphernalia, and similar charges) carry up to six months in county jail and are heard in the municipal courts of Toms River, Lakewood, Brick, Jackson, Manchester, and Ocean County’s other towns.

Many Ocean County cases start in Superior Court and do not stay there. If the evidence supports only a lesser charge, the prosecutor can downgrade the case to a disorderly persons offense and remand it to the municipal court where the arrest happened. A remand removes the risk of a state prison sentence and an indictable conviction, so pushing for one early is often the most valuable thing a defense lawyer does.

Common Indictable Charges in Ocean County

  • Drug possession and distribution, including fentanyl and heroin cases and CDS charges near schools and parks
  • Aggravated assault, including assault on a police officer, and unlawful possession of a weapon
  • Burglary, robbery, and theft, including shoplifting over $200 from the stores along Route 37 and Route 70
  • Eluding police, a third-degree crime that becomes second degree when the flight creates a risk of death or injury
  • Strict liability for drug-induced death, a first-degree charge the Ocean County Prosecutor’s Office brings in overdose cases
  • Fraud, forgery, and identity theft
  • Death by auto and assault by auto, including cases that start with a Garden State Parkway or Route 9 crash

How a Criminal Case Moves Through Ocean County Superior Court

Every indictable case in Toms River follows the same statewide stages. Knowing where you are tells you what decisions are coming next.

1. Complaint and First Appearance

Charges are filed by complaint-summons (you are released and get a court date) or complaint-warrant (you are taken into custody). A person held on a complaint-warrant must see a judge for a first appearance within 48 hours. Pretrial Services runs a risk assessment, and the judge decides on release conditions.

2. Detention Hearing

If the Ocean County Prosecutor’s Office files a motion for pretrial detention, the hearing generally takes place within three working days of the first appearance. The defense can ask for up to five working days to prepare. A detention hearing is the earliest chance to test the State’s evidence, so preparation matters.

3. Pre-Indictment Stage

Before a grand jury hears the case, the defense receives early discovery and the prosecutor may offer a plea, agree to a downgrade and remand, or consent to Pretrial Intervention. Many Ocean County cases are resolved at this stage.

4. Grand Jury and Indictment

If the case is not resolved, the prosecutor presents it to an Ocean County grand jury. The defendant and defense lawyer are not present, and at least 12 of the grand jurors must vote to indict. For a defendant held in custody, the indictment generally must come within 90 days of commitment, not counting excludable time.

5. Arraignment, Status Conferences, and Motions

Arraignment takes place within 50 days after indictment. The case then moves through status conferences, where discovery disputes are settled and motions to suppress evidence or dismiss the indictment are argued.

6. Pretrial Conference, Plea Cutoff, and Trial

At the pretrial conference the court sets a trial date, and the plea cutoff takes effect. After that point, negotiated pleas are generally not accepted, so the final offer usually comes before the conference. Cases that do not resolve are tried to a jury in Toms River. A defendant who is detained generally must go to trial within 180 days of indictment, not counting excludable time.

Source: NJ Judiciary Court Management Statistics, June 2026. Criminal figures cover post-indictment activity only.

Ocean County took in 18% more post-indictment cases than the year before, the sixth-highest total in New Jersey, and resolved 95% as many as it received, so the docket grew by 131 cases. Even so, Ocean’s backlog per 100 monthly filings is 147, well below the statewide figure of 250, and about half of its pending cases are still within the Judiciary’s time goals. For a client, that means a case here usually moves faster than in many other counties, and the early stages, before indictment, come up quickly. Preparing for the detention hearing and the pre-indictment offer from day one matters.

Alternatives to a Conviction in Ocean County Superior Court

  • Pretrial Intervention (PTI): a diversion program, mainly for first offenders, that ends in dismissal of the charges after a period of supervision lasting from six months to three years. Applications go through the Criminal Division at 732-504-0700, extension 64320, and should be filed as early as possible.
  • Recovery Court: formerly called Drug Court, an intensive supervised treatment program for people whose charges are tied to substance use. It can be an alternative to state prison. The Ocean County Recovery Court coordinator is at 732-504-0700, extension 64242.
  • Downgrade and remand: resolving the case as a disorderly persons offense in municipal court.
  • Dismissal through motions: suppression of evidence from an unlawful stop or search, or dismissal of a defective indictment.

Once a case is over, a dismissal or a completed diversion program can often be cleared from your record through expungement.

If a Family Member Is Held in Custody

People arrested in Ocean County and held on a complaint-warrant go to the Ocean County Jail, 114 Hooper Avenue, Toms River, run by the Ocean County Department of Corrections and located next to the Justice Complex. The jail’s main number is 732-929-2043, and the county offers an online inmate lookup. Visitors must preregister and be on the approved list before a video or contact visit. Call a defense lawyer before the first appearance and any detention hearing, because those first days decide whether your family member comes home while the case is pending.

Can my Ocean County Superior Court case be sent back to municipal court?

That removes the risk of state prison and an indictable conviction, and it is often the best early result in an Ocean County case.
