In State v. S.C., we were able to successfully achieve a dismissal of the Defendant’s Driving While Intoxicated, Refusal, and Reckless Driving charges. Our client faced a seven to twelve month loss of license on the Refusal and three months for the DWI. We did so by challenging the State’s ability to establish operation of the motor vehicle and by identifying crucial discovery issues. In order to exploit the discovery issues, we successfully introduced an order which was signed by the judge permitting the State to comply within a reasonable amount of time. At the following hearing, through oral argument, we successfully argued for a complete dismissal which allowed our client to avoid license suspension, steep fines and penalties, and installation of an ignition interlock.
