In August of last year, we had the opportunity to defend a client who had been arrested for shoplifting goods from a local Walmart totaling an amount less than $200. The Loss Prevention Officer (LPO) had allegedly witnessed our client pass the cash register area of the store with the goods before confronting our client. The encounter had also allegedly been captured by in-store security camera. At Court, we were able to challenge the State’s case due to the Walmart’s failure to provide the security tape. Eventually, after multiple hearings, the LPO was not present at the final hearing date. At that time, we entered an application to dismiss the shoplifting charge which was granted.
