Secaucus NJ Heroin Distribution Defense Attorneys

New Jersey heroin laws are particularly harsh and aggressively enforced. New Jersey statute section 2C:35-10 criminalizes the possession of heroin in this state, even in the smallest amounts. Things can get even worse if you are found with more heroin on you or if you are found with other evidence, such as wax packaging, baggies, or similar objects, that could be evidence of possession with intent to distribute the heroin. These laws apply with equal force to residents and out of state individuals who bring drugs into New Jersey. A recent case demonstrates what can happen if you are arrested in Secaucus or elsewhere in Hudson County and accused of heroin related crimes.

Federal and state law enforcement have reported that they seized 31 kilos of heroin, worth approximately $2.4 million, in Secaucus, New Jersey recently. If you are facing drug charges for possession or intent to distribute heroin in Secaucus, our Hudson County criminal defense attorneys are ready to assist you. A Secaucus Case of Heroin Distribution

Two out-of-state men recently stood trial on charges for possessing heroin with intent to distribute. Specifically, police seized over 31 kilos of heroin—a staggering amount by any measure—in Secaucus. The seizure reportedly resulted from an investigation into an alleged Hudson County drug ring with ties to Mexican drug trafficking. This investigation lasted for over three months, involved the New Jersey State Police Trafficking Unit and the New York Drug Enforcement Task Force, and resulted in the arrest of four people at an Extended Stay America hotel located in Secaucus.

Two of these arrestees were on trial this month for possessing over 5 ounces of heroin and possessing heroin with intent to distribute. The other two defendants pleaded guilty over two years ago to conspiring to distribute heroin, resulting in sentences of six years in state prison. Judge Patrick Arre of Hudson County Superior Court is presiding over their trial in Hudson County’s Administration Building, and the case is being prosecuted by the New Jersey Attorney General’s Office.

What Can Happen if You Are Caught With Heroin in Secaucus

Heroin possession, even in very small amounts, is generally charged as a third-degree indictable offense. You can think of indictable offenses as like felonies in other states, as they are tried in New Jersey Superior Court and can carry years of prison time. If you are convicted of a third degree heroin offense, you face a jail term of three to five years. You can also be subject to a fine of up to $35,000.

As for heroin distribution or possession with intent to distribute, this crime is regularly charged as a first or second degree indictable offense, some of the most serious offenses in the state. A single charge for selling heroin can expose you to the risk of ten to twenty years in prison and hundreds of thousands of dollars in fines. As evidence by the case above, you can also be charged and convicted if you participate in a conspiracy to distribute heroin, with similarly harsh penalties.
